Michelle Phan getting sued

I had forgotten all about the controversy that Michelle Phan has been embroiled in until I read your reply. Oh Goodness. It is all coming back to me. She hasn't had a clean record at all. You know those types of liars that tell lies that are things you wouldn't even need to lie about? Like they lie just because they are freakin' crazy? That is the type of liar Michelle Phan is. LOL.

So right now I am only remembering the really big stuff that she has been caught lying in. I know there are other things that are being left out but here it goes. So for instance Michelle lied about how her products with Lancome and L'Oreal weren't being tested on animals and she said she talked to a scientist who worked for those companies. She got caught there big time by another YouTuber and Blogger. She was also caught lying about how her products at the time were FDA approved and they weren't (so they weren't deemed safe to use) according to documentation that can be accessed publicly which was given a lot of attention to. There is more about her business ethics and professionalism that I have forgotten about but if anyone is interested enough they can do a quick search and get better information than what I can provide.

She has also been caught lying about posting art work on her FB and Twitter saying that she made but didn't numerous times. As far as I know she has been caught lying twice when she posted pictures saying they were of her but weren't. There are also make up styles she has taken credit for making but were actually shown to have already existed exhibited by celebrities and/or their make up artists. She also backpedaled about how she hadn't gone through botox and injections but had already done-so.

Oh Jeez. There's still more. A lot more. I don't mean to turn (or make it sound) this thread into a Michelle Phan Hater Parade but I don't hate her. I'm just trying to figure out why she would use copyrighted material in a video without getting permission for it. Now that I've started to remember she has had a lot more controversy than any other YouTuber I am starting to believe she really is crazy or believes she is above getting a license to use copyrighted material.

They are just going after Michelle Phan because she is so big and well known! Do you know how many YouTubers out there are making money off of copyrighted material? A lot. Infact, ever since they opened up the partner program to everyone and networks accept almost everyone, there are tons of YouTubers that knowingly upload content that isn't theirs just to make a profit. I don't believe that was Michelle's intent, she switched networks, so my guess is she used to have the licenses and now she doesn't. But I don't know a ton about the situation and I have only seen around 10 of Michelle's videos total.

It's not like "Poor poor Michelle is being sued" It is more like "She should have known better". The typical response I see from Michelle's Phans and sympathizers is that the record company who want her to pay up are just no good greedy sons of guns who are targeting poor little Michelle because she is popular. Well if Ultra was really greedy they could sue the smaller channels that use their music but they don't. You know why? Because those smaller channels are making pennies. They are not going to sue someone who uploaded a couple of their songs when those uploader's are not even drawing ad revenue. The record companies and other IP owners are just going to strike those videos down with copyright claims which would result in the uploaders channels being closed depending on the number of strikes as well as resulting in the ban of that channel owner. On top of that it is difficult for the Algorithm to detect copyrighted music when it is background music and has other audio over it so it is not entirely like Ultra was like "LETS GO GET MICHELLE!!!!". If they decided they wanted to just go after her, so what? They can sue anyone at anytime. They have the right to sue her if she was using their copyrighted material. You say that Copyright on YouTube is messed up but It simply states in YouTube's TOS that people shouldn't be uploading copyrighted material they don't have the right to use. That is what the problem is, people uploading whatever the heck they want because they don't care or don't read the TOS. Michelle, like a lot of YouTuber's, should have just taken down the relevant videos. That is why Michelle is lucky she was just given a warning first. She neglected it and is still lucky that the record company did not just put copyright claims on the relevant videos.
 
LJay you do have some good points. Copyright on Youtube is messed up but it would be a lot less messed up if people didn't upload stuff they didn't own in the first place. And record labels do have the right sue anyone they want uses their music. But I like I said I don't really know Michelles situation. And how do you know she received a warning first?

There's a couple articles I read I will bring up in a minute with an edit. Don't read TMZ or any of the garbage they are spewing on the matter. A lot of people on YouTube are getting their information from a video they did a couple of days ago.

EDIT: Crap. I forgot you cannot just link stuff. The sites I used and found that were helpful in obtaining information on the matter were Law360, Billboard and Uk.Reuters. They included the part where they had told Michelle she was infringing, not using a license and so on. Apparently over 50 videos of her's meet the criteria for copyright when it comes to their material.

Thanks LJay. With the internet and all this information out there sometimes it is so hard to be informed. Ironic isn't it?
