Michelle Phan getting sued

Yep. TMZ. Totally unbiased and trustworthy.
LOL. When I saw that it was TMZ, read the article and saw the comments I had to go out and find some more information.

EDIT: Furthermore, TMZ even did a video. I found it after doing a search about Michelle Phan being sued on YouTube. It was way more misinforming than the article they did. Comments are worse as well.

Plus I just have a problem with the whole "can't use copyrighted music" thing in general.

Copyright laws are in existence for a reason. If an 'old media' (television, radio, etc.) outlet show a music video or use a song, then the decision is made internally - someone sitting in the production office presses the right button, and then the outlet are responsible for paying up on royalties. YouTube themselves are not the ones adding videos to their service - they are being added by users, and by the labels and artists. YouTube can't afford to start paying massive royalties for videos, and outside of music videos, they don't really pay for any of the content on their site.

Michelle isn't new to this. She should have enough common sense as a business woman to know you either have to pay for the song or just not use copyrighted music by huge DJs - or else you will run into legal troubles.

I'm not too bothered either way. Michelle has a made a fortune from being a below average MUA who happened to come around a time when Asian YouTubers were blowing up. I'm sure she's lovely, but I'm guessing deadmau5 didn't want someone with millions of subscribers profiting off of his work on a video showing 12-year olds how to apply tinted lip balm.

oh I completely understand that like, it's not... My feelings on this are about like... the business nature of the world in general with a lack of understanding of the complexities of what really goes on. I just think to myself "If someone uses my music in a new way to create a new thing, if it's carrying and original idea of their's, if it's in the background cause they jammed out to it in their car, if it was playing in the grocery store, SWEET. My music's out there, as long as there is a clear disclaimor saying who I am and where you find me, that helps me, I'm not going to demand money, the exposure will help me in the long run."

And then when I hear about companies who are already doing just fine financially, getting hung up over people using background songs, the naive idealist in me is like "Music should be more free than that". You're taking a much more realistic and "it's already this way and there's no getting around it" etc etc, I know I know. I just hate the concept of not being able to use music in simple and creative ways that don't just profit from the song itself alone.
 
To be fair, anyone who is saying that just applying music to the background of her videos isn't that bad should question this. If its not that bad, why not just add any old music to the back ground ? or no music at all.

People get so mad when a youtuber rips off another youtuber, but if a youtuber does it to a musician it's not really a big thing. At the end of the day that musican probably but a heck load more work into what they produced then the youtuber did, but yet the musician will get less respect for it. She knew she was using copyrighted music and she just has to suck it up and deal with it, she brought it on herself at the end of the day.

If i went and ripped a bunch of her videos and used them in videos I made, I very highly doubt she would put up with it if she saw it.

LOL "all these people" I think at this point it's just me saying that TBC hahaha and I just feel like I don't know… Like I said if you have used a song of mine as the main focal point of your video and it's the reason that people are watching it and this is blatantly obvious, I completely understand this, but I have just never thought it seemed right that someone can't just have it in the background as long as they give credit to the artist, I just can't really see the big deal in it and I guess it's because I know myself I wouldn't care, but maybe I'm just weird, or maybe I just haven't had anyone explain this in A way that gave me a new angle on it.

It's a general attitude on youtube, not just you. I find videos on a daily basis where they have just blatantly ripped copyrighted material and made content with it. Just because everyone does something, it doesn't make it right. They have a legitimate argument, she doesn't so at the end of the day you have to stick to the rules of the game or your gonna get disqualified.

Well yeah I'll agree that it's "just the way it is" and she should have known better. I mean my original outburst was when I thought they wanted ALL her earnings I didn't realize I was reading an article written by lab monkeys.

They probably did say that, but everyone in business always goes in with a higher offer so when bartering takes place they will go down to a lower offer to make the other side think they have won and got a good deal. In reality the original person just played them the whole time.
