They probably did say that, but everyone in business always goes in with a higher offer so when bartering takes place they will go down to a lower offer to make the other side think they have won and got a good deal. In reality the original person just played them the whole time.

Well yeah I'll agree that it's "just the way it is" and she should have known better. I mean my original outburst was when I thought they wanted ALL her earnings I didn't realize I was reading an article written by lab monkeys.

By 'all earnings' they don't mean they're trying to take everything she's ever made on YouTube ever (even though that is a bit funny to imagine) moreso a cut of the profits she made from the particular video that used their music - which sounds fair to me.

Alright I get that. You know I've never even seen these videos, she may do like vids where she mutes her own sound and almost makes a fashion related music video with their songs, and if she did that I'd see this quite differently. Stuff like this just reminds of times when you hear like... someone got sued or whatnot for having a song on in their car while they were talking to people barely realizing it was there and such. I think Prince got p****d about something really stupid like that once and I just.. feel like it shouldn't go OVERBOARD. But maybe it's not in this situation.

She doesn't but it shouldn't make a difference either way. All she needs to do is pay for a license to use the music and the problem will go away. All this negative press is designed to do one thing-make her pay for a license. Michelle Phan is the most sought after YouTuber by corporate brands. There's a reason YouTube chose to promote her channel first when it ran a pilot program to make YouTubers common household names. Any underhanded tactics on her part make her less attractive to corporations that shell money for custom videos. If she doesn't settle soon, the brand deals that go away due to negative press are going to cost her more than what a music license would.
 
I want to throw one more thing out there. Last night I came across a few comments as I was looking into this whole Michelle Phan Sued thing about how Gamers on YouTube are allowed to use Gameplay footage and how they don't get into trouble. The thing is that isn't exactly the same thing with music is it? When you post Gameplay and monetize it you are actually allowed to by some companies who are okay with it or actually encourage it because it is free promotion for them and it sends people out to buy the game. Gaming YouTubers aren't actually posting the game itself, just a recording. So no one is getting the enjoyment of the game for free through this method unlike Music. It is more like a preview.

With Music it is a simple digital audio file. It is not a program or application like a PC game. You can go to YouTube and search up your favorite musical pieces and find that the uploaders usually don't have permission to use said music. If you searched up some Video Games on YouTube you are not going to find any actual game to play. I Imagine people who come across music they hear in certain videos on YouTube go searching for it on YouTube or some other Website or Torrent Program and download it through something like YouTube Downloader or a File-Sharing app. This was a very scatter brained reply. I had some more mumbo jumbo about the copyright issue with video game footage and music but I'm really blanking right now. I need a nap.

I didn't grasp what he was saying at first. But I think I get it. it's like, "there's so much music out there she COULD use, and being Michelle Phan would not make it difficult to find plenty of cool stuff that she has the right to use, so why deliberately use music that she doesn't own" correct?

Pretty much, she knows about copyright and she knows that she shouldn't be using them songs without the proper rights. This pretty much all falls on her, as they say, the chickens have come home to roost.

I had forgotten all about the controversy that Michelle Phan has been embroiled in until I read your reply. Oh Goodness. It is all coming back to me. She hasn't had a clean record at all. You know those types of liars that tell lies that are things you wouldn't even need to lie about? Like they lie just because they are freakin' crazy? That is the type of liar Michelle Phan is. LOL.

So right now I am only remembering the really big stuff that she has been caught lying in. I know there are other things that are being left out but here it goes. So for instance Michelle lied about how her products with Lancome and L'Oreal weren't being tested on animals and she said she talked to a scientist who worked for those companies. She got caught there big time by another YouTuber and Blogger. She was also caught lying about how her products at the time were FDA approved and they weren't (so they weren't deemed safe to use) according to documentation that can be accessed publicly which was given a lot of attention to. There is more about her business ethics and professionalism that I have forgotten about but if anyone is interested enough they can do a quick search and get better information than what I can provide.

She has also been caught lying about posting art work on her FB and Twitter saying that she made but didn't numerous times. As far as I know she has been caught lying twice when she posted pictures saying they were of her but weren't. There are also make up styles she has taken credit for making but were actually shown to have already existed exhibited by celebrities and/or their make up artists. She also backpedaled about how she hadn't gone through botox and injections but had already done-so.

Oh Jeez. There's still more. A lot more. I don't mean to turn (or make it sound) this thread into a Michelle Phan Hater Parade but I don't hate her. I'm just trying to figure out why she would use copyrighted material in a video without getting permission for it. Now that I've started to remember she has had a lot more controversy than any other YouTuber I am starting to believe she really is crazy or believes she is above getting a license to use copyrighted material.
