Text of their statement is below. That goes against what was filed in court, so this seems to be a ploy help her reputation. IMO, a bad move since it acknowledges that her reputation was hurt by the lawsuit.




Ultra’s lawsuit against Michelle Phan lacks any merit. Ultra agreed to allow Michelle to use the music and Michelle intends to fight this lawsuit and bring her own claims against Ultra.

Michelle’s intention has always been to promote other artists, creating a platform for their work to be showcased to an international audience. Kaskade, whose music has been featured in Michelle’s videos, has publicly defended Michelle against Ultra’s claims and acknowledges the success he’s gained from her support
 
The funny thing is that most Youtubers would want compensation if their content was used to make money without their permission, but when a record company wants compensation we get all up in arms.
 
This whole thing seems weird. I mean if she has been using copyrighted music for years now and on so many videos. Why are they just now sueing her? Did it really take them two years to find out she was using copyrighted music?
 
So now things are getting a bit strange. If she did have permission to use the music, all she has to do is produce the document and the lawsuit goes away. Her legal team issued another statement this afternoon saying that Phan will sue Ultra Records, so this is shaping up to be a very ugly public PR war.

Thru licensing. It can get complicated but what I learned from my Music History Professor is that all you need to do is find out who the copyright holder of the material is and just get in contact with them. With music you don't contact the band/artist of that music piece, you want to go through their record company. A lot of the time bands and artists don't even have rights to their own music. Anyway, once you can get in contact with the copyright holder inquire about getting permission to use their material and how the process works. It is not as difficult or intimidating as it sounds either. With those of us Gaming Channels getting permission is usually quick and simple. With Music I would not know how that can go. I'm sure you would need to pay a fee for licensing as they are not just going to give you the rights to use their music whether you are making money from it or not but I can't say for sure. It sometimes depends on the copyright holders.

Sounds like it's just an all around better idea to use free music. (For non-gaming channels, of course.)

Oh no, sorry. I meant for us Gaming Channels to get permission for using Gaming Material such as Footage. Nintendo are one of the more ardent companies who do not want people making money thru footage of their Games. Everyone else is cool with it. A lot of companies even send us Gaming Channels free stuff for reviews if we ask.

Ohh I see. On the music aspect, I think I'll stick with uncopyrighted works. Sounds like a good deal for you gamers, though! :D
