I'm sure she's gotten away with next to no consequences before as have many others. I think smaller Youtubers possibly have not been found out and it's easier to find the larger youtubers. Maybe everyone is just cracking down on it now that YouTube is becoming more mainstream.
I don't take any pleasure in what she's going through but if she knew better she doesn't have anyone else to blame.

She likely made close to half a million off of those videos..

If she didn't pay the licenses then she does owe them alot of money.
Licenses are there for a reason, is she chooses to ignore them and then ignore the their follow-up then I believe it is right for her to be threatened legal action and for her brand image to be damaged.

Her tweet is pretty ridiculous IMHO. She's doing people a favour because she's inspiring them to dance WTF?

Has anyone heard of the Doctrine of Laches? Do you think it will affect this case? A lot of people are saying that Ultra just waited for Michelle Phan to get successful and make a lot of money to sue her for copyright infringement. Could that be a defense in this matter? I'm sure they would have a hard time proving that though.

They lost ALL rights to their earnings and relinquished all royalties.
 
Trouble with copyrighted music is an amateur's mistake on YouTube.
I wouldn't say it in those words, exactly. YES it's definitely more likely to happen to newbies and people who don't really know what they're doing... but it happens to even the biggest and best of companies. Copyright is as backwards as Mel Brooks' a** in Spaceballs. Even legal pros have difficulty with it sometimes.
 
On topic it was said before that they will just settle out of court, and it is the music label flexing its muscle. I don't think it is an issue of them waiting on her to get famous. It's good ol' copyright infringement with an icing of a broad warning to other youtubers.

While I agree that if she chose to ignore buying licenses that she should be threatened with legal action. It just blows my mind that they would consider each one of their songs worth $150k a piece. That's simply what I was saying, the price they set to sue at just seems completely inhumane. It'd be another story if they were suing for say $2,000 a song. Especially considering the people in comments who always ask for the song name and end up finding a new song to add to their inventory.
