Hey there everyone, Dolphin Squared here. Now before I start, I would like to emphasize on something. This thread is not intended for flame wars towards Nintendo. Even though it's based on the rumors, I do not like to have to be answerable to the damage in relations amongst anyone, myself or the admins of this forum.

Now, back to the main topic. There's been a rumour surfacing this morning (or whatever day it was at the time I posted this for you guys) that Nintendo has taken action on Copyright ID claims. To elaborate, videos containing Nintendo products and are more than 10 minutes long are slapped with a copyright claim.

Apparently, quite a number of YouTubers are being affected by this matter. While a number of YouTube partners like myself appear to be unaffected, other gamers are affected by this matter.

This thread is meant to be informational, and involves all who are gamers or Let's Players on YouTube. Like I said earlier, keep the discussion as impartial as possible.
 
There's nothing really to say (in my opinion).

The content belongs to Nintendo, and Nintendo only. It's their discretion whether to lodge copyright claims or not. It's a shame, especially for those with Nintendo channels with longer videos, but gaming videos are not original content. I have a gaming channel and whilst I appreciate that I am the one playing, talking and editing etc, the audiovisual is not actually mine and if (for e.g.) Ubisoft decided I wasn't allowed to play my Far Cry 3 videos any more, I'd stop.

That's just my 2c on the whole situation :)
 
Basically, this means that if you get the claim against you, you cannot put ads on that video, and the company (Nintendo) puts ads on it for themselves, and make that money. I'd just say to not put copyrighted music in your videos, as it only becomes a claim if there's no commentary for 30 straight seconds, which just shouldn't happen.

Funny you saying that I have noticed that Nintendo gaming vids have the highest rate of non-commentary in all the gaming vids I've seen. Not sure if that's across the board, but deffo the ones I've come across!

To be fair, you are playing their game, they own the rights to it, so why should you make money off of it? I know it doesn't seem fair but they are a business and losing money from this. A lot of companies do this. Some developers are fairer at least, and do allow you to monetize their gameplay either by contacting them or simply just allow it under fair-use.

Really? Can you think of any examples? I know there are the routine examples of people uploading game music, but is the actual gameplay without commentary really common? If it is, I think that for the most part it's fine for them to claim it, as you arne't doing anything to make it yours. It's like if I just uploaded an episode of Adventure Time to my YouTube channel. The copyright holder would have every right to claim it. However, if I review it or put commentary over it, that's a different story.

True, they don't even hurt you for getting the claim, they just want a dime in ad revenue from your video. Is that too bad? If it is made original content through reviews/machinimas/LPs/etc, that's different, but if it's just the game footage, I don't see the big deal.

I believe Rigpop used to do no commentary nintendo (I forget the name of his channel, but he's a user here). Whether that's changed I don't know. I also saw a few times some no commentary Zelda vids.

Exactly. It's different if it is under fair-use, but if you are just uploading gameplay, then it's just their content your uploading.
