Nintendo Copyright Claims Discussion Chat

Just to point out, I have got a friend who did an entire series of Fire Emblem: Awakening. And he never added commentary on any of his gameplay videos. That's one example for no-commentary Let's Players.

To be honest, I have been facing third-party claims since doing Pokemon news reports. But then it's all because I had recorded footage of their Japanese shows. Then again, at times like this commentary really acts as a shield against this claims.
 
As long as they don't take down videos, I think it's okay. Well, it sux to be in the wrong place in the wrong time, but in the end sometimes you just gotta admit that it's not your content.

I disagree with the idea that the video claims should go through if you're placing commentary over it and using it in fair use. Then again, when it comes to the LP without commentary, how is it really original content? Half the fun of gaming videos is watching the person's personality come through and hearing their reactions to things. If you don't have that, what's the point? You're literally just playing the game. In my mind, that's equivalent to just uploading a TV episode to your channel.
 
hope this wont be a problem for a future plan of me making a whole mashup of some well-known tracks in gaming, including some nintendo owned tracks :/
 
Wait wait wait...is Nintendo also filing claims against videos with their content but with commentary over it?

Basically, are Let's Plays of Nintendo games all right?
 
Funny you saying that I have noticed that Nintendo gaming vids have the highest rate of non-commentary in all the gaming vids I've seen. Not sure if that's across the board, but deffo the ones I've come across!
Really? Can you think of any examples? I know there are the routine examples of people uploading game music, but is the actual gameplay without commentary really common? If it is, I think that for the most part it's fine for them to claim it, as you arne't doing anything to make it yours. It's like if I just uploaded an episode of Adventure Time to my YouTube channel. The copyright holder would have every right to claim it. However, if I review it or put commentary over it, that's a different story.

True, they don't even hurt you for getting the claim, they just want a dime in ad revenue from your video. Is that too bad? If it is made original content through reviews/machinimas/LPs/etc, that's different, but if it's just the game footage, I don't see the big deal.
well nintendo has pretty much the widest librery of games that you dont always want commentary over. some RPG's for example, catchy story and stuff, commentators would only ruin it by talking over it :P
 
I believe Rigpop used to do no commentary nintendo (I forget the name of his channel, but he's a user here). Whether that's changed I don't know. I also saw a few times some no commentary Zelda vids.

i post on that channel as well, and as far as i know they always had commentary, another guy however (there are 3 of us) had his mic some low that you could barely hear the commentary.
