Might have to bring my Banjo Kazooie LP to halt if this is true :/ Time to find other games!
 
well nintendo has pretty much the widest librery of games that you dont always want commentary over. some RPG's for example, catchy story and stuff, commentators would only ruin it by talking over it :p

Are you referring to cutscenes? If there are voice actors, those voices will disrupt the music. If there is none, just read the text, and that should suffice. If there's some scenery or something in the cutscene, just say one thing once in a while.

yeah you could read the subtitles, but some people just prefer to hear whats going on, kinda like a movie, also with subtitles you would rather not have someone talking.
 
I still don't understand, I'm pretty sure this is only for their video game music and for gaming videos of their games without commentary.

When it has commentary, they can't detect it and you should be in the fair use category.
 
Just to point out, I have got a friend who did an entire series of Fire Emblem: Awakening. And he never added commentary on any of his gameplay videos. That's one example for no-commentary Let's Players.

To be honest, I have been facing third-party claims since doing Pokemon news reports. But then it's all because I had recorded footage of their Japanese shows. Then again, at times like this commentary really acts as a shield against this claims.
Not overly. I had to take a load of mine off and they all had commentary :(

Well, that's kind of what the subtitles are there for, to be read. Sure, some people just skip over them, but if they're there and it'll cause you to stop making commentary for multiple minutes, I think it'd be worth it to read them. I just feel like if you stop making commentary and just show the cutscene in its raw form, you've stopped making it original content, and are instead just showing art that someone else has already made.
