Surely if he is mis-lodging complaints and dislikes and causing your account to be suspended if it continues, isn't that classed as mis-use and abuse of the feature and it should mirror to him and keep you in the clear.

Because that video has the strike, if you upload another video that video will not be linked to the strike.
From what i've heard youtube can still remove the claim even without the video, but i am not 100%sure
