In order for a content match to occur, the owner of the content must have uploaded the material into the system. There is far more content that exists, than has ever been entered into ContentID.

The reason I mention this is that you're not the first nor will you be the last who wonders whether not being flagged means it is ok. This is not correct. Just because you didn't get "caught" so to speak, doesn't mean you won't be. And hell, there's always the possibility that you monetize it and it never gets hit. That's the "getting away with it" angle.

Ultimately, my advice is to be very careful when dealing with copyrighted material. If it hasn't been automatched, then it requires someone manually from the owning company to submit a DMCA takedown which is unlikely for old material in that way. But is that a risk you want to take?

As @offbeatbryce mentions, cover songs are not by their own virtue applicable under a fair use defence. In order to apply fair use to a cover, you will generally do it in one of two ways. Either a Weird Al style parody of the original content or content owner (Rule of Thumb: Parody is using the content to make fun of the content, Satire is using the content to make fun of something else. Parody is protected, Satire is not.), or by doing it as an educational video ie. breaking down how to play the song for others.

P.S it would be really awesome if people would stop guessing in threads regarding legal issues just to pad their post count. This is not the place for guessing. You are putting people's channels in danger by giving bad advice.

As I pointed out sometimes the content is in the system but never gets picked up till later. I know this because certain publishers tell me sometimes the automatic system fails and they find it later and tag it and decide what they want to do with it.[DOUBLEPOST=1430358407,1430358325][/DOUBLEPOST]

This is the single most important thing in this thread...as a matter of fact it should be part of a sticky somewhere. People do not realize how much damage they can do with misinformation or incomplete information. It's only an innocent flippant comment off the top of your head but to her it could mean a copyright strike or worse (losing her privilege to monetize e.g.). Please be careful and only give advice about this sort of thing if you are 100% sure you are correct. I know you guys mean well and she appreciates the help but just be careful.

Unless you wrote the song you can't monetize it legally. Even if you get away with it for a while that will just make the monetary damages they seek worse when they do find you. It's only a matter of time before someone gets mad and reports it.

If YouTube Allows you to share in revenue with the song then you can monetize it.
