youtube monetization inquiries

Hey guys! :)

I really need your help on this, ok I'm absolutely aware that we can't monetize a youtube video that include a song owned by a third party, and most of my guitar covers have copyright notices on them so it means I can't make money off it and that's ok I'm pretty satisfied. on December 10, 2012 I made a guitar cover of the mortal kombat theme song and it has never had any copyright notice until now, the video has more than 250k views and I'm thinking of monetizing it if it is possible and I don't want to get my account into any trouble, there are many people who made renditions of the mortal kombat theme and their videos are monetized. do you think that I wouldn't be in trouble if I do the same ? thank you so much in advance :)

I think it is under fair use, coz u r not stealing their content, u r composing something out of that content! U can't monetize anyway but u can file a dispute!
 
@ Jawad Soomro thanks my friend, but no I don't need to make a dispute as the video has never had a copyright notice on it, it means I can monetize it anytime I want but I want to know if it is fair to do this, I'm doubting that the Youtube Content ID didn't identify my video ? maybe ? I do want to monetize my video but if it is risky I will never do this. so how do I know if it is legal to monetize a cover song if the content ID didn't "caught" me, I mean how can I know if the mortal kombat theme is eligible for monetizing or no. Thnaks!

Dude Its a fair use, u can monetize it! :) I just use SOUND EFFECTS of mortal kombat in my videos, I'm not monetizing it, but I didnt catch any copyright :)
 
I know that guys, but how to determine if a song is eligible for monetization or no ? I want to know if the mortal kombat theme is free to use or no bbecause I have never had a copyright notice on it + I see many people who monetize their videos using the MK theme

My guess is it's not legal to monetize unless it's in the public domain. I highly doubt that it is. Sometimes a copyright notice is not filed until a year after the video is uploaded.
