I just got flagged for "Community Guideline"???

Right you can appeal a strike once every 60 days unless it was flagged under a specific category that doesn't allow appeals (p**n, nudity). Doesn't sound like your own video either, best to stick to your own content even if it doesn't get flagged you could just get a copyright strike instead :)
 
That sounds like that may be the problem here...
Does that mean I can get to go use the same reason flagging off all the same video where the "killer whale eats man"? Probably he/she mean it was gruesome and graphic. It had nothing to do with copyrights.

Right...but, if it wasn't your video in the first place that could have been means for it to be taken down by YouTube. I'm not sure what video you are talking about, but if was violent and/or gruesome then that is also another reason for it to be taken down. You don't know, the other may be taken down as well.
 
I would appeal it...but if its not your originally shot video I think you will probably lose. Google doesn't care and they make it really hard for anyone to make money unless you're a partner.

Also, this video is all over the internet and youtube. Yes, it's not mine. If go to youtube and type in search "Killerwhale eats man" you'll get quite a lot of users who has uploaded the video. And those videos aren't uloaded yesterday. It's been around for years.

Indeed if it's not your video, you don't even have the right to upload it. So there isn't anything you can do against it.

AND YouTube is not a shock site. Don't post gross-out videos of accidents, dead bodies and similar things. A shark eating a person is not against the guidelines, so that's why people flagged it.

Okay, I agree with you, but not entirely. Okay, just for argument sake. Right now I thinking this very rationally.
I am guessing you understand the rules applied to Copyright Infringement and content ID. If a person does not register his claim to his property the item remains to any person living. Let's just put it this way, you buy a car but don't register for it, until and unless you register the car, you cannot claim it to be yours. Now a person gets in your car, drives it away, and he can claim it's his, can you justify this? Can you go make a claim that THAT CAR belongs to you? That's the reason almost all the movies and music has copyrights. The thing here is, it's not about copyright infringement. It's about graphic/gruesome and gross. If it is copyright infringement, I'd gladly remove the video myself. But the thing I am very upset is, I am taking the beating while others have the privilege of uploading the same video all over youtube. It just doesn't seem fair play to me.
