They don't lol. No network's have them. It's called fair-use, and they advise partners on what games they can and cannot monetize.
 
Yes, they do. If they don't have licenses how do you think networks like machinima let you post gaming videos I think they'd have thousands of lawsuits by now if they didn't.

Sorry, but you're just wrong. I've talked with all of the major gaming networks and plenty of small ones and every single one of them monetizes via fair use. Any individual or business can do this.

Nope. Remember Sega and their phantasy star 3 or whatever game that was? They suddenly decided to up and flag anyone with videos of that game and EVERYONE got but, even people partnered with big time networks.

It all depends on the games and their developers.
