DigDis partner refuses me to leave them!? HELP!!!

Dear Youtubers, I have a BIG trouble for now.

I am multimedia designer [artist, animator, music and video producer] and owner of following Youtube channel named "djnykk":

I've opened it in 2007 but popularity grows around 2.5 years ago.

Today I have over 72 million views: 200.000 views per day, 5.5 million views per month, nearly 50.000 people are following me which I think is success as all you see is created entirelly by me [one-man channel] :)

2 years ago I started monetizing channel with official Youtube partner company from Germany called "DigDis" only because I am from Serbia where it was impossible to enable monetization.

According to SocialBlade, my channel is on first place in DigDis network!

Now PROBLEMS:

DigDis people were extremly correct and polite UNTIL 3 months ago I announced leaving them in Youtube partnership because I've found a better firm that takes less money and gives more. But I plan to stay for selling music on iTunes and others.

For example - DigDis takes 30% from monetization of my whole channel + 10% [because Serbia is not part of EU and then we [authors] can consider this as a "punishment"] + 5% is taking our bank while they are sending money to me each month. Payments are on time once they starts paying, but overall they are late between 3 and 4 months [since I started monetizing].

Contract for Youtube partnership with DigDis is ending in next 2 days - actually on May the 28th I should get up and see my channel as free on this link when I am logged into youtube: features sublink.

BUT DigDis refuses to disconnect me. They claim contract with them ends on May the 28th NEXT YEAR [2015]! I've signed a contract for using their software for music releasing - Konnekt and to make working with Konnekt I had to sign contract to start selling MUSIC [not Videos of course] and ending date there is really May-28-2015.

But in contract text writes this:
"... Agremment shall be automatically renewed for period of 1 (one) year each unless one of the parties gives the other writtem notice of its decision not to renew, which notice must be given at least 3 (three) months prior to the applicable renewal date."

I have ANNOUNCED leaving in written form [I have e-mail sent directly to DigDis owner] exactly 3 months ago and I followed rules.

Now they keeps telling me that I am still with them until next year!

It is more than known my channel is getting them lots of money while I am the only one who is NOT satisfied at all [based on many other Youtubers I am getting between 10 and 25 times LESS money + they are taking ~45% from that money]. I feel very bad and I am now asking for help - what to do and how to make them release my channel as we agreed 3 months ago?

On this page DigDis is listed as certified / official Youtube partner [just open Europe]:

Thank you very much for taking time to read my problem. Let me know if you know some answers.

Best regards,

Never heard of DisDis.

But anyway, YouTube will not get involved with network disputes, you need to get in contact with a lawyer.

Never heard of DisDis.
Thats probably because DisDis is a Music Distributor. So the guys that bring your music on Spotify, Itunes, Google Play Music, [name any online music store / streaming service]

Your should contact a lawyer. For Germany i could recommend you wilde beuger solmecke. They are specialist in Web and have a huge knowledge about YouTube.
I didn't read the contract. But i guess this Music Selling Agreement includes some parts over your YouTube Channel. And since this agreement is agreed until 2015. No Chance.
If they renewed the agreement for one more year after you told them you want to leave, then a lawyer should get you out

Thank you very much for your info. I am already in contact with two laywers [one in USA and on here in Belgrade], but I will gladly contact Wilde Beuger Solmecke and see what they think.

Last few days were extremely stressful to me, I am an artist, not lawyer so this was very hard time and now I am spending lots of time speaking with people to see what to do to leave. Tomorrow will be the day I was waiting for and will have some final talks with lawyers. I really hate when people are unfair to me, especially when I was fair with them.

I am just thinking about next possible scenario: in case IF I will have to stay with them one more year - next year when other company starts to monetize my Youtube channel - I might get Copyright Strike from DigDis? It might be possible, as looks like they betrayed me with contract as they have all exclusive rights called "digital bunch" [!?] Looks like my hard work might belong to THEM [like I worked for them!?]. All this seems unreal to me - people who were asked to "click the button and make ads appear" are now OWNERS of my work!?!?!? I hope I will not have opportunity to take legal actions, but looks I will be forced to do so and go to the end!

Thats not possible in Germany. You always own your work. Wilde Beuger Solmecke would be a good contact because they know the German Copyright Act better then anyone in this Forum or i guess even as everyone at DigDis ;)

Looks you are giving me reason to continue believing in people. Thank you :) This is message I've got from one of them:

"yes, you have canceled the contract and that’s why it’s not auto-renewed.
but that has nothing to do with the normal contract running time - the contract runs until 25.05.2015 (initial period is 2 years) as it was set up on 25.05.2013.
you can see this in the sentence before.
and the contract guarantees us all rights for all your products (music titles, albums, compilations, videos etc)."

Doubt it, if he gave them all distribution rights, then they have all distribution rights, those and ownership are different.
