will gaming video be consider as copyright infringement?

I am not a gamer, but just out of curiosity, I saw a lot of gaming channels that are very small thus obviously wasn't partner with any network. So I just want to know if it is ok to do a gaming video if you have commentary, or if you not monetize it, or they are just risking it, and because they are small, youtube won't pay attention?

Strictly speaking if you post a game that requires a license without a license (some gaming networks provide these) it`s illegal and therefore you can be striked as you don`t own the rights to the visual portion, as long as you have commentary and don`t try to monetize it YouTube usually turns a blind eye, but some publishers arn`t so lenient and will either strike your video or match it as third party, EA and Rockstar games do this alot, Also Microsoft are also harsh on posting games without a license and will strike down really hard if you try to monetise (even with some full partners) ;)
 
Most gaming networks give you what you need to get out of copyright trouble. Most game companies turn a blind eye, since it's more or less a waste of time, though some (EA, Ubisoft) will want to monetize your videos so they get a profit.

But do NOT monetize the videos. Once you do, your at risk of losing your channel, never getting a partnership, and in some cases, even a lawsuit. Partnerships are okay, but don't monetize them, or you can really screw yourself.

Shane, this got me thinking. Is there a master list networks provide with a list of license they own, and then pass that along to partners in their network that have gaming channels?

Machinima has a big list, Vultra has a smaller list, Yeousch has a smaller List, TGS has a list.
You have to ask for each network.
