Actually, you can still get a strike.
If that video was just a direct upload of the original Tom and Jerry episode, then it is 100% Warner Brothers' content, and they have every right to take it down, especially if it was monetized.
You cannot reupload the entirety of someone else's content.

You just can't upload someone else's content, regardless of whether or not it's already there.

In my opinion, that video should be taken down, especially because it is monetized, but I have a feeling they get away with it because it's a "Best of" video compilation, and not a direct reupload of an entire episode.

The first one is sped up slightly, so it wasn't automatically caught, and I'm not sure about the second one.
Look, regardless of whether or not other people are doing it, it is illegal.

Think of it this way:
You make a video on your own channel, upload it, it gets a few thousand views. Nice.
A couple days later, some random person downloads your video, then uploads it to their own channel, monetizes it, and gets a couple hundred thousand views.

Not only are they stealing views and profit from you, they are making money off of your hard work.

Whether or not you monetise has nothing to do with strikes. Not monetising doesn't protect you from anything.
