You absolutely can argue fair use whenever you want. You don't need to go to court before doing anything, hoping the judge gives you permission. ALL new media works this way.

Second, to the people who commented akin to "they used copyright stuff, no sympathy", please go read up on copyright law. You are part of the problem.

The only prob is YouTube can say 'lol no' and we really can't do much unless we got the endless pockets to take then court. We talk about courts and lawsuits but someone has TO ACTUALLY DO IT to make a difference.

YouTube can take down your content for any reason at any time. This is the perogative of private entities. That doesn't change the fact that we're operating under fair use. It's also why you see companies using the YouTube system and not taking YouTubers to court, because in court, they can lose.

Just in case anyone was wondering, this appears to be a case of delayed processing by YouTube. WatchMojo was given 7 days to provide proof that their material was indeed theirs by Fox. They contacted Fox, which issued a retraction. YouTube did not process the retraction in time, which led to the takedown-and it appears that the 7 day period was over a few days earlier than expected because of a delay in WatchMojo receiving notice. That led to the 21 hour takedown. Once YouTube processed the retraction, the channel was restored.

I don't understand why Google doesn't lobby to make fair use stronger, do they not know they are at war with old Media lol. Those people who don't feel bad lol, yeah lets keep giving big companies a break they could really use it! How many times has a network (tv network) used a clip from YouTube and asked no one for permission, but we have to beg on our knees to use their stuff. I understand the point of copyright, but with any law that is a tad bit general, it is used and abused, by the rich & powerful. I think there needs to be a clear line drawn between "Copying" and reviewing , commentating, etc.

P.S. i don't use copyrighted material, but i see the oppression of the little people!

Not for nothing but this whole copyrightapocalypsae thing is a bunch of nonsense. It just seems that people have gotten so used to being able to monetise their videos, they have failed to stringently check every single video and ensure that what they are doing is allowed. Not that the companies are any better, this is hurting their public image more than anything else

In my opinion, Google does lobby for fair-use. In the end, it is up to the copyright holder to determine if they want to protect their work and it isn't YouTube's place to get in the middle of that argument unless YouTube is directly being sued.

There are plenty of companies that lobby and use their wealth for things that are not it their "place." I haven't seen any knew legislation so i don't think they are lobbying that much, RIAA is though, they have new legislation every year, doesn't pass but they do it.
