Pssh, I wish. The only violation that I think they might be doing is 4-H of the ToS, where "you agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Service in a manner that sends more request messages to the YouTube servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. " But of course, there isn't a way of proving this. They can just argue that they have a bunch of people spending their entire day flagging videos for no pay. Whatever they're doing, no matter how they're doing it, they're taking it way too seriously. What in the flying f**k. Is there any way we can get THEM taking down?
Besides, I doubt YouTube will get rid of Spam404, because they actually do (sometimes) take down channels who actually deserve to be taken down, like abusive accounts, scam accounts, impersonation accounts, etc.
