Playing a game and adding your commentary makes it original content, meaning it's covered under fair use. However, you still need to have the rights to the game in order to monetize those videos with advertisements. There are two ways to do that. Either try and contact the companies in the hope of getting them to approve you, or join a network that's already done this, like fullscreen or TGN. You can't just automatically do so though, like I couldn't monetize gaming videos like Ray can.

Once again, you need to have the expressed permission of the copyright holder. For example, if you did that of one of my videos, you'd have to get my permission. That's obviously much easier to do with one person than with a massive corporate conglomerate though.True.
