Generally speaking, the legality of recording has to do with what is called "reasonable expectation of privacy". This is why you can vlog outside, but vlogging in a public bathroom would cause potential problems. The same could be said of flying your drone over someone's private property.

The argument against the commercial use statement in the second link is that the monetary exchange is not for the video. This is the same as for things like video game content. They all reference "commercial use" as against the terms, but commercial use is referring to the selling or pay-gating of the content. So having a subscription by pay YouTube channel could constitute commercial use. On YouTube we as creators are showing our videos for free, and selling our viewers to YouTube advertisers which is a bit different.

It sounds a bit more to me that the FAA is trying to strongarm people away from advertising how much fun drones are to play with. lol. The FAA rules were clearly intended in relation to for-profit flight in the manner of commercial airlines, not people posting hobbyist videos from their remote control "toy".
