Nintendo Removing Video Game Music?

Heya, I noticed that on one of my other channels, where I had video game footage on it and had a part with some Super Mario Galaxy music, (some of this on other videos as well), Nintendo had filed a copyright claim against my video.

I know it's completely in their rights to do this, but when has this started? Since when did Nintendo really give a crap about if you have their music on your videos? I've been on YouTube for years with that other channel with those "copyrighted" music tracks by Nintendo, and they're just now filing these claims.

I do have a question though, if I have an intro with Nintendo's music, will they remove that as well? Or will it be under fair use to a degree since there's gonna be things other than videogame footage being on the screen?

Yeah, I don't see why they would copyright that. The only thing you're doing when you upload a video with their music in it is making them more famous. And yes they will claim copyright on your video if you have nintendo music at the start and/or end of the video, I tried it already

Ahhh, darn...

I did notice however, that Nintendo did not remove the music that was remixed. I had a series of videos with Nintendo music in each one, they only removed their original music, but the remixes of theirs, they did not claim copyright on. So, I believe that if you were to put a musical remix, then it'd be fine since it's fair use

More than likely they won't claim copyright on your video if the music is remixed, because the auto-detector that looks for music in your video that is owned by another company will not recognize the song that you have remixed. The only way they would claim copyright is if they saw the video themselves, which I highly doubt, so it's technicly safe

I've recently gotten a copyright claim on one of my videos (it was an acapella cover of a song), so I know how this process works. Basically, nowadays YouTube identifies a video as containing a song or clip that is copyrighted. When this happens, it gets added into their system, they place ads on it for this original copyright holder, and you have to confirm that you acknowledge the copyright claim. Recently, Nintendo, as well as many gaming companies publishing games through Nintendo (like Sega), have been adding their soundtracks to the youtube content id match system. To avoid this, you cannot allow a music clip of one song play for 30 seconds or more without commentary. If it's then made background noise by your commentary, it will be all right. Getting the notice doesn't hurt your channel though, just say you acknowledge it and everything's fine. YouTube doesn't even list you as being in bad copyright standing!

Yes, you acknowledge that the video uses content that you do not have the rights to, and you agree to let them (Sega) place ads on your video and make money from them. Of course, this means that if you become a partner, you can never monetize these videos.

If you acknowledge the fact that it's their music, then YouTube will put ads on your video and won't let you monetize that video. But even though you acknowledge it, Nintendo can still claim copyright whenever they want.

Technically, they already are. They claim the rights to your videos and put ads on it. They just aren't following the traditional YouTube model of deleting the video along with all similar ones and placing a strike on your channel. I personally believe that this is a better way of handling it. Also, I can't think of a single time where YouTube has made progress in some way like this, then 'regressed' into a worse form of the past. I think there's little concern of Nintendo taking legal action against you.
