Live and learn. It's pretty common knowledge that in games like GTA you need to have the car radio off since you don't have permission to use the songs. In a lot of cases, YouTubes content ID system catch most of these cases, not the copyright holders themselves. Some are nice enough to remove the claims once disputed but a lot won't want to set a precedent of letting people get away with using their stuff for free. I agree it is pretty stupid but we don't get to dictate how this plays out.

Using the tags "pewdiepie" and "markiplier" do not relate to your videos just because they share a topic. If you get caught doing that kind of inappropriate tagging YouTube can terminate your channel. I would highly recommend reading through the TOS agreement and other materials YouTube sets out to avoid things like this if you want to spend the time to build up a channel risk free.

On the up side im pretty sure strikes are removed after a period of time, so it can be recovered from.

That's all people do anymore, buddy. Profit off of other people's work. Everyone builds off of everyone else's content. Otherwise we'd still be in the stone age inventing our own wheels. What I do is my own content. I play the game and add my personality to it. It's a lot like being a sports announcer, except instead of watching the game I'm actually playing it. I'm commentating on the video game while playing it and entertaining the audience, so the content falls under both the critic and entertainment industry.

Might I ask what you use to make your animations? Probably Flash or something similar, right? You didn't write the programming for that, did you? Well then why are you trying to profit off of other people's work?


First off, that was my first video that I uploaded over a month ago before I knew how to work with SEO. Second, that is hardly key word stuffing. In fact the only two I would take out there are "markiplier" and "pewdiepie," but those two still relate to what I'm doing which is let's plays. There are literally 10 keywords there and you're going to tell me I'm stuffing? Now you're just grasping at straws.

Bottom line: If you don't like my content, don't watch it. I'm following fair use just fine.

Using a program like Flash to make something isn't profiting off Flash, it's like people who draw, and sell their work, are they profiting off the paper and pencil? F*** no, his animations are his own original, whether he uses Photoshop, Flash or Paddy's Animator it's his own original content, not to mention I'm pretty sure Adobe can't do anything about him making money off that since what he made is his own intellectual property, but the let's plays you made on games aren't yours, since your video contains footage from that game.

Okay great, they were bad tags. Big deal. It was on one video that I made over a month ago and in 2 seconds I can go remove them. I'm still relatively new at this so excuse my mistakes.

As for the Let's Plays, it's long been established that it is legal under fair use. People literally live off of their Let's Plays and nobody makes a fuss about it. On top of that, a big part of the Let's Play is the player's personality. You can watch two different videos with the same video game and different people playing them and get totally different experiences. There's a lot more to it then just being a neckbeard who plays a game with a camera in front of him.

I'm not weighing on the ***** waving contest, but just on this particular point. No, it has never been established that Let's Plays are fair use. That would require a court battle which has not yet happened. Let's Plays are allowed right now because the companies choose to allow them, and YouTube is so large that for the companies that don't allow them, protecting un-matchable gameplay is too difficult.

Okay that makes sense. I just always thought that people can monetize them because it's considered fair use. Thanks for clearing that up.
 
To expand on that, most game developers have a YouTube specific clause in their terms of service agreement clearing anyone to use their gameplay for these purposes. Some however still require written requests so they provide you permission (example, Activision). If you post a game play video on any Nintendo product, 2K or a couple others, they will copyright claim you.
 
From what I've heard... according to Youtube rules it is allowed to monetize gameplay videos as long as it is with Your own commentary which is tied strictly to the live action showing in the video (or something like that). At least that is what George (CEO of Freedom!) is saying in his video.

This is true, but still only for the developers which allow creator content featuring their game. The idea being you can't just upload a gameplay like a giant movie, you have to actually contribute to the product and make it your own.

George said in his video that some developers (like Blizzard) give You explicit permission to use and monetize footage from their games, but he also said that even if a developer doesn't give explicit permission to do that then according to current YouTube rules it is okay, as long as You have Your own commentary tied to action of the video.

Search for: "Can I monetize all gameplay videos? Yes! If ..." if You want to see the video.
