Michelle Phan counter-sues

But with that large of an audience, don't you think that would be un-smart of Michelle to use copyrighted music without permission.
Not in Michelle's case. She thrives on controversy. Her public image contains that innocent and clean look where people would never peg her as someone who is capable of causing such a stir. So when people see her at first glance and hear of a situation like this one a lot of them immediately make assumptions based on her outward appearance and automatically think "F*CK THOSE MUSIC COMPANIES!!! SHE WOULD NEVER DO SUCH A THING!!!" without doing their own research on Michelle Phan first and discovering everything she has been caught up in. She's had more scandals than I managed to list in the last thread about this issue and quite possibly more than any other YouTuber. So either Phan is guilty and she is dragging this out with her counter-suet or she is not guilty and still dragging this out without providing any proof she had the right to use Ultra Records Music. Either way she will still be getting attention which I'm sure is what she is looking for.

EDIT: Like it has been stated above me, I kind of feel like Michelle probably has something she has not shared.

If she used copywritten music without permission then she should be sued especially because she has a larger fan base. Small Youtubers get dinged all the time for using music they shouldn't be, it should be the same for her. If she wants to use the music she should pay for it. Mind you, if she paid for it then the suit is going to make the music company seem like idiots.

Should be interesting to see how this plays out...sometimes these highly publicized things have a way of setting precedent.

Did you even read the story?

Kilgore knew of Phan, and he wrote in an e-mail that Ultra was “more than happy to let [Phan] use this content.

That's according to her statement, we have no proof of this yet so it is only one side of the story.

Note that Ultra Music has been sueing others lately as well over sampling and using music, multiple artists have been fighting lawsuits made by Ultra. It's a big mainstream record label, they like to make money and so they will try anything they can to get it. This is one way of getting your bucks! Interesting stuff is happening, I'm also really interested in seeing how Deadmau5 is going to try and win the lawsuit against Disney over him using the mouse head logo which resembles Mickey Mouse a lot...

I read the story but we really don't know either way. We'll have to wait. She'll have to produce the email.

Kilgore might not have the authority to give permission. The music label might contractually have rights to distribution and useage.
