Couldn't you find some similar eerie/creepy music that's royalty free just to be really safe? The odds of them actually striking you're channel are incredibly slim but it's a gamble.

They are allowed to, yes, but they have no rights to strike your channel (or make any real legal claim) because he is making no money from it.

Why would that have anything to do with anything? You're still essentially giving out something under their copyright. There's FUP and everything, but that has nothing to do with monetization of the content.

(I think Walt Disney died a while back... Not sure though.)

But indeed, rather go for an actual royalty free piece of music to make all the worries go away.

Perhaps get a muso to make a song very similar to it? If you change a few notes here and there, people will get the reference and you avoid any copyright issues? Just an idea though :3

Don't they just make a claim - you accept it - and continue to use the music? I play+record music games and just acknowledge the claims and move on - I don't monetise anything.
