Hey so, I plan on using The nightmare before christmas song, This is halloween (an instrumental version) in the background of a tutorial im doing
im not monetizing the video so I'm pretty sure ill be fine but just been safe

Before I say anything, do know that it REALLY depends on how generous the record company and/or creator are. I used "Little Things" in one of my videos (don't ask) and didn't monetize it, but still the company (I don't even know if it was the legit record company) claimed it, and ended up banning my video in like 3 big countries. Usually they won't claim unless you've monetized it, but if they're a selfish company... well... You get my point.

But, assuming the company isn't greedy (forgot who made/published The Nightmare Before Christmas) you should be fine. Make sure you know the publishers/etc. of the film so you can appeal any false claims.
 
It doesnt matter if you monetize or not, if you dont have permission they are aloud to flag.
They are allowed to, yes, but they have no rights to strike your channel (or make any real legal claim) because he is making no money from it.

I'm pretty sure they do have the right to request a strike on your channel if they choose. It would be YouTube who would make the final decision but who are they going to side with, a publisher who doesnt have permission to use the track or the copyright holder who can hold the publisher as liable for breaching copyright law ?

You can read about it on the google help section, I can post links but google "youtube copyright strike" it was the top result for me. It says nothing about the requirement for you to have ads on your video to receive a strike.

I can't say you're right. If what you were saying is true, then you'd be breaking the law to just share a song with your friend.

I'm going to break it down to two simple things.

1)
They possess the ability to flag you for any given reason if you're using they're work. Doesn't matter if it's monetized or not.

2)
If you monetize someone else's work (song, for example) without correct permission, you WILL get flagged.

See the difference?
When you DON'T monetize it, there's a 50/50 chance you get flagged, but, if you do, the punishment is a LOT less severe. I quote myself.

Worded differently:

If you do not monetize the video of copyright-stuff, it depends on how nice (insertcopyrightownerhere) is, as, they can flag you at will.

If you DO monetize the video, YouTube steps in and claims you automatically.

Ah, he (Walt Disney) was (is?) a nice guy.
Unless the person who's in charge now (I think Walt Disney died a while back... Not sure though.) is a jerk and doesn't care about Walt's wants/how he wanted Disney to live on, you should be a-okay.
 
Moving this to the copyright section, personally I wouldnt touch anything I didnt create myself without proper permission/license to use it.
