Is this a scumbag move?

Hey guys, I recently uploaded the intro of battleborn.

I obviously didn't make this myself, I used shadowplay and had it recorded and uploaded in 15 mins. I was the first person to upload this on youtube, and it got a fair number of views. I cant help but think its a massive scumbag move though, as I didn't create it. Thoughts on this?

if you added nothing to the video and it was only footage of the intro with nothing added then id be careful you don't fall under fair usage there.

I just thought it was a really cool intro and wasn't on youtube, that's why I uploaded it. Also, as for fair usage, I've not monetized anything (no interest in doing so for a long time, I'm not really gaining anything from this). There are a ridiculous number of intros on youtube that have uploads of game intros. I'm not using this to defend myself or anything, but you can find a ridiculous number of soundtracks on youtube that would fall under 'fair usage' no?

I like to stick to this so i know im in the clear for making videos and i know i have a case against any copyright action taken against me, it also doesn't matter if you monetize or not, i dont and have had a video claimed before but obviously i won the case. as for other people uploading soundtracks and stuff its obviously completely up to the owners of the rights to the music, its just i wouldn't do it to be safe lol[DOUBLEPOST=1462399567,1462399444][/DOUBLEPOST]plus those soundtracks could have been claimed on buy the a third party or copright holder and has chose to monetize the video so he gains the money instead of the original uploader

I just said... I'm not defending myself and justifying anything. Youtube is fairly grey on the matter, hence why I'm here, asking. It's very interesting that there are raw uploads of 10s of millions of views on a single video which aren't getting pulled down. Makes me question all of this.

Uh, yeah, so? And I'm simply answering the questions you pose. Bluntly, but hey, no need to gently curb notice of misuse of copyrighted material.

Wut? No they're not.
Taking content that you don't hold the rights to and uploading it is not permissible at all. It's super simple and straight-forward.

The grey area comes about where to draw the delineating line between what constitutes fair use, but that itself is something that occurs in court and to content that's actually potentially transformative. Raw content never is. (The entirety of raw content with somebody's face in the corner isn't either.)

10s of millions of views on a single video which aren't getting pulled down. Makes me question all of this.

Perhaps even un-caught theft.Copyright holders have to waste their own time and energy to request stuff to be pulled down. That's a massive time sink. Copyrighted content from overseas might never even get claimed by the rightful owner if there's no localization of that content. Out of curiosity, I've even contacted some companies alerting them that blatant theft has gone on to see if a proper response might happen in a timely manner - it didn't (might happen one day, but that would be months of wait, and I doubt it would be my email that caused anything to happen anyway).

It's not a move that makes you look especially good, I think. It will bring views, but it could also bring you a lot of grief. What I would say is that it's not up to us what this is, it'll either be taken down or not, it'll either lead to a lot of views or not, and whether that makes it a "scumbag" move is entirely a matter of opinion, so it's up to you how you feel about it.

It is, but who cares. You've done it, it helped you, now move on. It's not cheating if you don't get caught. Of course, take this with a grain of salt from someone who has absolutely no qualms whatsoever with someone trying to beat the system or take shortcuts. I started one of my channels in 2009 and jump started it by uploading a clip of copyrighted (Network TV) content. Almost 7 years and 6 figures later I can tell you that I feel no guilt about this, but like I said, I don't consider myself a good guy. Still, as far as I'm concerned, all is fair in Youtube. I wouldn't make a habit out of it, though.
