I don't think it's fair use if you are making income, however if you aren't monetizing, you may be right.

I always just look up "Public domain pics of such and such" and use them... I then put whatever site I find them on and I've done it for like... 6 months now on quite a few videos... not sure if I'm treading in dangerous territory but my standing's still good.

Best thing to do is make your own thumbnail pictures to protect yourself thats why most dubstep artists will protect them selves by using one image plus makes your videos stand out

The YT Copyright crap is ******* me off. It's like trying to make a video about say..... Gaga's latest weird-a** outfit... without being able to show a damn photo about it. People watching the video wouldn't know what you're talking about and would appreciate the visual aid there.
