If I were to create a gaming channel...

indie games yes, any other companies games are strictly forbidden....you better love minecraft.
 
Fair use is a really complicated subject. On top of that, it can only be argued as a defense in front of a judge, meaning you have to go all the way to court to officially use it. If you want to do a gaming channel, either a) do it for fun and don't monetize, or B) spend a lot of time doing research and even try contacting the game companies for permission. But don't waste your time if you're only doing a game channel as a way to get popular on YouTube, there's already about a billion people doing that. ;)
 
You do not have to be partnered with a network to do gaming. Networks do not have licenses for games. That's a fallacy.

All you have to do is commentary on the video. You need to find out which games allow their video to be used but avoid cut-scenes and mini-movies in the games.
 
Actually, for you to do gaming without a network for now, you must include commentary on everything. Your video will most likely get a copyright strike without doing so. As monetizing goes, I wouldn't do that for gaming videos.

We are a gaming channel and we did not dare monitize our videos until we got partnered. Once partnered with a gaming network they hold some commercial rights to make money of ads on games if said games have full commentary, no cut scenes (or at least commentated over) or montages with royalty free music.

My advice to you is put the videos up, do not claim monitization and if a gaming company states that there is third party involvement then acknowledge it. This will reduce the potential of getting copyright strikes.

Bide your time and build an audience, then attempt to join a gaming network. Once partnered you can claim your videos through them and get a cut of the monitized views which will be stated in their contract.

You don't need a network to monetize gaming videos if you have permission from the developers/publishers. However monetizing with adsense is a pain in the a**. On my other channel, I have permission from the developers to monetize their game and showed it to youtube and 1 month later, it is still under review. -_-

I was only thinking of doing it for fun, but I noticed that other gaming channels do monetize their channels and wasn't sure where that fit in a legal since...

Non-sense, i have a gaming channel and many of my videos are monetized given that they are multiplayer gameplay, or have commentary. Also no strikes at all apart from a content ID claim on one of my montages that used a POD song.

That's because it's multiplayer, and not a campaign (which usually receives strikes)
