HELP ME - URGENT

I have checked the channel and they did start before me but have been inactive with no videos. The made the channel (Dec 10 2011) and there have been no videos uploaded at all.

What should I do? How would you respond?

From working in law for several years: unless they can prove that OutsideInGamers is a copyrighted trademark, there is no action they can take. ESPECIALLY since they have no content, and therefore are not established.

If it ever did 'go to Court' (it never would, just hypothetically), you would likely win, because you are the more established channel since you have content![DOUBLEPOST=1369599507,1369599415][/DOUBLEPOST]I have a similar story from years ago. I had a Lord of the Rings fansite for a little while and it was called Lord of the Rings Online.

There was a more established website (run by a fan like me), who had the domain lordoftheringsonline.com - mine was just a poxy free website on a free subdomain lotronline.whatever.com

They threatened legal action to me, but once I refused to back down they simply ignored me and went away.
 
zHey guys, thanks for your help and here is a little update:

I replied after much deliberation saying: "Hi, add me on skype and we can discuss but I WILL NOT be changing my name."

I received a reply saying

"Our time zones are completely different, so I seriously doubt the likelihood of us actually being able to hop onto skype and talk about it. Your account was set up long after our account, I find it extremely rude of you doing this."

I basically replied with all of the points you guys made :

"Please explain how this is rude. I had no knowledge of your channel and how would I be able to?

The channel has no videos so YouTube search did not bring this to light.

You have 3 Subscribers on the channel meaning I am more established, I'm not just going to chuck away 84 subscribers that I have worked my a**e off for but creating a brand for myself.

I have had my channel since Aug 2012 so why wasn't this brought up before?

Finally the channel hasn't had any activity in the last year.

I swear to God I was not aware of this when I was creating the account. If this happened to all accounts with similar names, the YouTube community would not exist.

I would like to ask what "action" will be taken.
