Hey guys,

Just got this message on Youtube:

Excuse me mate, my name is DANIEL, along side Rhodri, and we own the name OutsideInGamers, and we find it extremely disrespectful that you have used our name for your channel. I would recommend changing your channel name, otherwise we will take action!

I have checked the channel and they did start before me but have been inactive with no videos. The made the channel (Dec 10 2011) and there have been no videos uploaded at all.

What should I do? How would you respond?

As you actually make videos and they do not, they have no right to say they "own" the name, by copyright law you and your name are a separate entity from them as your name is different , they do not even produce content, they can do nothing, I wouldn't worry my friend :)

Thanks :) I just dont want to get botted... I was furious when I saw :/

It is not about who made the name first, it is about who copyrights the name first, they can literally do nothing unless they have paid to take out copyright to protect their unused channel[DOUBLEPOST=1369559663,1369559551][/DOUBLEPOST]

also i just searched their names, cynicalchips does not exist and the other guy has only 7 videos the last of which was over a year old, they are nothing
 
They cannot do anything if their name is not registered.

And still it's the internet. Your name is outsideingamer and theirs outsideingamers. There is a difference in the name :P
You have had no knowing of that account before they contacted you. I don't think they can make anything out of it.
They could maybe if they are a registerred trademark otherwise just no.

You could respond:

Hello Daniel and Rhodri, I am sorry to hear that. I have had no intention to copy your name and did not know of the existence of your channel.
I'm sorry to say but I have no plans to change my channel name either.

Yeah, it's always a smart move to escalate a situation...

Tell them, in a nice way, sorry dudes, never heard of you guys, hence didn't copy any names, c ya around.
