Earthbound LP/Trouble with Nintendo?

With today's release of Earthbound on the WiiU Virtual Console, we're thinking about doing a playthrough of it for our channel. I know Nintendo has loosened up in regards to their "anti-LP" policy, but could playing through a Nintendo game still get us in hot water? We got a 3rd Party Content match on our first Mario WiiU video. We're not a channel that generates revenue. We have monetization enabled, but we don't have any of our videos monetized.

Record one or two episodes and see what happens, if they claim then pull down your vids if they don't then you're golden

They let you do LP's, just not earn anything of off them.
But I think I read something about them removing the claiming of videos some weeks back.

(But if you use direct footage from them, of course you will get 3rd party content)

To my knowledge they only really care about newer games. I've done some older titles, including Earthbound, and have had no trouble whatsoever. You should be fine.
