Loop holes to what? They have the right to take down material that infringes their rights, per US law.

Ah, see I am talking about British law, not American.

So long as the original copyright author is credited, usually they don't have to take down the video (unless its generating money or they are really annoyed and want it removed.) I am not out to cause drama. I am just warning people to be careful. I have seen so many channels who haven't even so much as credited the Game publishers or Developers with the title "My Gameplay" which could land them is hot water.[DOUBLEPOST=1400878426,1400877796][/DOUBLEPOST]
There certain games that aren't allow to monetize. You should check around which games are allow to monetize. Example Left 4 Dead their creator allow montize. Final Fantasy 14 Realm Reborn, is monetize available. So it just need to be study thats all. Also be careful with the music.

I am honest, until channels get signed to companies such as Machinima, channels shouldn't be monetising any of the videos.

Oh okay, remember YouTube is governed by California law so other laws don't apply. :smilingcute:

Also networks don't have any commercial licences to major publishers either.

Ahh I didn't know this.

Strange I always thought networks would liaise with the publishers and offer them a cut. I thought that was how they dealt with the copyright. But I guess the TV/Film Industry is slightly different to YouTube.

I personally don't know any network by name that handles legal issues re copyright related for every partner of theirs. They only do that with their top tier partners usually.
 
Do you or him have a source for this? This seems very weird, and to me sounds very untrue since it all depends on the game developer.

His channel might of gotten banned for playing copyrighted games or using other copyrights material.
Like someone said earlier, all games are copyrighted, but most developers encourage putting footage of their game on YouTube for more exposure to their game. Some companies are complete asshats about it, Electronic Arts, while others are a lot more laid back about it.
 
Nintendo games, new or old. however, they won't take your videos down, they will just claim it. And basically all newly released games, you can post footages but not cutscenes.
 
So basically avoid EA, Nintendo, and showing cutscenes of any recently released games that risk spoiling it for people that haven't bought it midnight release?
 
EA is not bad but you must really careful with some games(like the EA sportsgames). Many of the EA sportgames have licensed music(like the GTA radio stations). Just edit out the music and you should be fine.

For most games cutscene's are fine if it is part of a walkthrough, let's play, playthrough ect. Stand-alone or isolated cutscene's are bad yes(don't upload!). I record all walkthrough's/playthrough's with cutscenes included and never got banned or copyright strikes.
