Can you get copyright from a thumbnail?

If someone finds a thumbnail on google images and then just reuploads it to their video, can they get copyrighted for that?
 
What Inifinite Paths said. It's one of those things that people have gotten away with over and over again. Could you be slammed with a copyright strike/ slam somebody else with a copyright strike over a thumbnail? Sure. But in reality it isn't something that usually happens.
 
Their is no automated system like with video or audio (Content ID) but yes, you technically can get a copyright take down request for you thumbnail.
 
thumbnails have been tested in the supreme court as fair use. In fact, Google was sued many years ago for displaying thumbnails in the image search. The supreme court ruled that showing thumbnails is fair use. I would think this would be a simple and fast ending court case if someone got sued.
 
I make beats and I made a west coast one for the straight outta compton movie and I used a straight outta compton movie wallpaper and like 7 months in I got a claim from universal manually made that it had visual copyright when it was just an image I immediatly deleted the video reuploaded with an stock image of los angeles and it was all good

Except that was in regards to search engines.

Two of the criteria passed the fair use test because their use was needed in order for a search engine to work and link to the original and that their use would only help the original copyright holder gain more publicity...neither test would pass from use on YouTube.

actually it wasn't The supreme court also mentioned that thumbnails in news reports/ blogs etc were all fair use
