Breaking the rules? Baracksdubs being partnered with RPM...

Hey guys :)

This is pretty much a question thats been bugging me for a while....

How is it that BaracksDubs is partnered with RPM, and is able to monetize his videos? Surely this isn't allowed for the following reasons
  • Doesn't own instrumental compositions he uses (even if he remakes it)
  • Doesn't own the clips he uses (of barack obama)
These are pretty much the main reasons, which would normally prevent them from partnering.

I'm only asking this because a friend of mine on this forum (@Cameron Dubs) is thinking about a partnership, but got rejected from Fullscreen from the above reasons... Would the same happen for RPM?

Please, I need someone to answer this from the RPM Network.

He's actually with Maker not RPM :P

RPM as on socialblade is actually "Maker Studios 3" or Maker's affiliate Content Owner.

There's quite a few Maker, Paramaker, Maker Music, Polaris etc (Makers "Premium" verticals) partners in it also.

So for the reasons you stated he's on affiliate, he can't do any harm to them on there so :)

I see no rules being broken on the channel you mentioned, This is simply a case of the channel having a really good understanding of copyright law.

First what he is doing is 100 percent transformative.
Second he isn't using the original music recordings, he is recreating them for the transformative works.
Third maker studios has several licenses with major record labels for things such as this.
Last but not least, the video in question you mentioned with obama was taken from the whitehouse.gov website.
Those videos were prepared by an officer of the federal government.

Obama is not a private citizen as the president of the united states of america.
Obama and all congressional figures are contracted with the United states as official round the clock active duty officers. Much like being in the army except they can leave office by choice.

work of the United States government, as defined by United States copyright law, is "a work prepared by an officer or employee" of the federal government "as part of that person's official duties.".[1] In general, under section 105 of the Copyright Act,[2] such works are not entitled to domestic copyright protection under U.S. law.

This means that in some cases you can use footage of Obama and various other federal employees without worry.

This does not mean you can use NBC footage willy nilly, But it does mean you can get things from sources like whitehouse.gov and CSPAN.

Also keep in mind, Only US citizens can do it, If you are not a citizen of the US then the copyright holds and you can't use the footage.

Hopefully that explains things a bit better.

I'm not sure if you're familiar with UK Law, but I think we have something similar to what you have mentioned.

We have an Open Government Licence (www.nationalarchives.gov.uk/doc/open-government-licence/version/2/) which covers the recordings of David Cameron (UK Prime Minister) too.

Would you mind having a brief look over this for me please (it's not long), and giving your reccomendation as to whether this is practically the same? (As I am a UK citizen myself).

Also apart from this, I believe I also meet the other criteria you stated at the beginning of your post. Would this mean that RPM (Maker Studios) should accept my channel too?
