Used copyrighted music in a review.... is that allowed?

Now 'that's' good to know! Thanks. Man I wish there was a place where I could get some more info on Fair Use though. I spend a few hours reading up about it, and it seems I'm in my right to make a review and then use music from the thing I'm reviewing in the video.

It's an important lesson to learn. To counter it, I'll try having no more music without me speaking over it.
yeah, the problem no longer lies in just fair use though. Yes, it is legal, but Youtube still does not allow it. Also, their is an amazing video that Stanford put on Youtube about fair use. Look it up and watch it if you are really interested in learning more about it.
 
You cannot monetize a video with copyrighted content or content you do not own. Sorry, you could get in a bunch of trouble that way and it's best if you don't.

Then how do channels like Game Grumps do it? Or the Yogscast. Or any independant reviewer on Youtube?

It depends on the music. Game grumps generally use music from old video games. It's music that belongs to game itself.

Let's imagine this scenario:
The new FIFA 2014 will include a song from Skrillex. FIFA Developers talked to Skrillex and negotiated with him in order to be able to use the music on the FIFA game.
Even though the music is being played on your console, the music still belongs to Skrillex, NOT the game.
If your doing a let's play of a game of FIFA and the Skrillex music from the FIFA game pops up, you're making a copyright infrigment.

Because the owner of the content decides if their content is free to use or not. FIFA Developers allow all uses of the game content that they own TO ANYONE (as long as it's displayed along with the game). Skrillex does NOT allow use of the music that he owns.

Right, makes sense. But I've got another question. Take for example... Angry Joe, he reviews brand new games and makes money off of it. How come he can do this?

You can do it too but you need to be smart like him.

In my opinion, Angry Joe:
  • Is partnered with a gaming network
  • Avoids having much CutScene time
  • Avoids at all costs showing parts where music by popular artists is featured on the game
  • Commentates during 90%> of the time.
  • Creates many content. He appears on screen a lot while not showing the game.
  • Doesn't do spoilers
  • Knows a lot about copyright. Blocks/avoids anything that can infringe copyright in his videos.
New games that are still on the market, you need to be more careful, but you can still do it if you do in "Angry Joe" style since it falls into the "Fair use" category, but note that this a very grey area (even AngryJoe risks getting in trouble if he doesn't make a good effort to create a lot of his own content during a video review).
