So I came across this channel

I've done some research about HassanAlhajry channel because I want to do no commentary gameplays myself and here is my conclusion:
1- you must get permission from the game publishers which could take a while (every single publisher).
2- you can monetize your videos without partnership with any network (like TGN or Machinima) because you have the publisher's permission, so why to join a network? to get more optimized ads, more views, better ranking and some features.
3- some publishers (like 2K Games) will not allow you to monetize your videos unless you have a huge channel like Hassan's channel and he can monetize the trailers because of this (a lot of views = publisher consent)
4- at first YouTube will review your videos and ask you if you have the permission, now I'm stuck here with my channel, I told them I have permission and now I'm waiting (my videos are set private) and I don't want to do this with every single video I upload so I'm still searching for a solution, maybe if I got partnered with a network will help, I don't know.

Its a gaming channel with play/walk throughs. Now what I thought infringed on copyright rules, this channel promotes its. No commentary just records his gameplay and uploads it. Am I wrong about this channel is it ok to do this? Any thoughts?

You need to understand that YouTube is not perfect. They hardly can manually review every upload. Their automatic reviewing is mediocre at best.

You are correct that in order to qualify for fair use they should have commentary on the content. However just because they don't doesn't mean that YouTube is instantly going to shut them down.


I believe that you HAVE to talk I think they said 70%? of the gameplay for it to be covered but hey channels get away with it and I doubt anythings going to happen to him so can't do much I personally think it's more fun to talk during videos "except for cut scenes"
There is no set % for how much needs to have commentary. Fair use simply lists the factors which are considered when determining if something qualifies, including commentary. There is no set length/percent that you are 'safe' if you meet.

In reality fair use is the excuse/reason we CAN monetize, but nothing is ever going to go to court.

False. These licenses don't exist. Period. Trust me, I've asked a LOT of networks about them, including all the major gaming networks (TGS, Machinima, BBTV (TGN, etc), Fullscreen's Arcade, and more). All networks use fair use to allow their partners to monetize, hence why most direct you to have commentary on top. (the others that don't direct you to do so are lazy and know the risks of getting caught are minor, and also know that if a channel DOES get in trouble, the network isn't at risk, just the partner's channel that could get banned)[DOUBLEPOST=1373088655,1373088494][/DOUBLEPOST]

2 & 3 are wrong/misleading. Networks have no licenses/agreements allowing you to monetize. Being larger doesn't mean you are safer or suddenly get permissions

4 - This is the trouble everyone on adsense deals with. The automated system is better at catching some games rather than others.
When in a network there is no review process, videos are automatically 'claimed' rather than 'monetized', skipping the 'review' step.

I meant what you said, you can monetize only by the publisher's permission not by the partnership with any network and by bigger I meant when you ask for example Rockstar Games if you can monetize their games they will say NO, but if your channel gets a lot of views you have to ask them again and they will allow you. Obviously, not my area of YouTube but it's just one more thing that I have learned about Networks.

They have gaming hubs or focus yet they actually don't have specific protections. Even if you do commentary, the video game content owners could still file a claim. Mind you, I'm talking about the video games that don't give specific permission to use their material.

They could file a claim, you'd have to counter-claim, and they could deny it. Then you'd have to take them to court and argue fair-use. The networks won't be doing anything to help.

I know a lot of people who upload game content without commentary and they are partnered with non-game networks. This is clearly against the rules but it works. The only things that can happen to your vid is matching third party content (not critical) or publisher manually bans your video with copyright strike (happened to me in november 2012)
That was Yakuza 5 demo vid. I suggest to avoid monetizing SEGA and Nintendo games even with network's support.

I was told by curse (union of gamers) they had "some licences" I assume they don't have it for nintendo stuff etc. I have no proof other than a response to a question I asked.

Ask them to see the agreement in detail.

Any such agreements with a publisher will absolutely have the following information:

* length / duration
* Limitations? (All games by a publisher? Includes singleplayer? Cut scenes? Trailers? In game audio?)
* Valid only on youtube or on more platforms?
* Payment - does the copyright owner get a fee? A % of all earnings? Something else?

They won't be able to provide that information as it doesn't exist. What I've had to do is keep asking detailed questions to try to determine if they are just saying 'we have permission' meaning 'we have permission via fair use to monetize this gameplay'. Some really, really don't want to admit that this is the case. Others are fine with it.

Thanks ill ask them that. even if they don't I may still go with them cause naything is better bbtv but I have yet to see the contract but according to the website it's no lock in contract. I asked here about opinions of people in U4G but got no replys :(

I've heard their CPMs aren't very good (one larger partner said $3 prior to splits) which granted is much better than many BBTV offers but overall is pretty lame. How big are you/what is your channel?
