Networks that are offering 100% Payout are scamming YouTubers?

"4.1 VOD Content. Subject to Creative's compliance with the terms and conditions of this Agreement and the terms and conditions of any other agreements Creative may have with Curse, for each piece of video content that is displayed in streaming VOD format on Creative's YouTube Properties hereunder, Creative shall be entitled to receive from Curse the lesser of 100% of the YouTube earnings or three dollars ($3.00) for every thousand (1,000) ad supported video views that such video content generates via streaming online VOD distribution."

Any opinions if this is 100% of everything your channel makes OR is it probably also 100% minus certain "fees"?
It means if they can get more than $3 per 1,000 monetizable views... they keep the overage. If they get under... they keep nothing. At least, that's how we're reading it.

Basically, they're betting on getting more than $3 in this example and getting the overage. Which also means the creator is "capped" at $3 / 1000.

That's how we're reading it. The operative wording is "the lesser of".

We wouldn't call it a "scam"... it is deliberate and careful wording... but aren't all contracts? lol

Then what's the point of saying they'll give 100% payout? If they manipulate the "fees" like that, then the % they're saying they are offering doesn't even matter.


I dug a little deeper: Couldn't access TGN's new 100% contract, they went confidential on their contracts with this new 100% payout deal. However I found out that other networks are starting to offer 100% too. Curse network, who has their contracts available to the public, has an "emerging market contract", directed for non-english channels. The following is an excerpt from the contract:

Just google their contract it's public. However I did search their contract for that keyword: no results.

@Freebie I wouldn't call it a scam. They do cap the earnings at $3 CPM, but they don't try to hide it.
 
EDIT: I mistook Curse for TGN, my apologies
I think because Curse caps at $3 dollars, it makes business viable. The company is generating some revenue for itself.
I think TGN and other networks that offer a simple "100% payout for all no caps" isn't viable. The company generates no revenue.

So with TGN it's either a temporary deal to lure in partners and then lower the payout to collect money, which is a no-no OR it's not temporary and they do offer 100% of what they claim to be all earnings (but actually isn't, so it's a scam), which is a bigger no-no.

The question here is:
Is there anyway to check the money that YT pays (without any sort of cuts), in order to verify that the network isn't scamming?

I think Maker Studios is the only one that has transparency into actual earnings where you can view your earnings on youtube just as if you still had your own adsense account enabled. Hopefully all other studios will follow suit and have the same policy.
 
It`s 100% Net revenue which is after BroadbandTV takes out 40% of what originally came from YouTube, Its just another way of saying it.

Used to be : 80/20 split with TGN using their 20% to pay off staff,premises etc.

Now : 100/0 Split ; but only after Broadband TV have taken 40 percent of what YouTube gave them, so now TGN dosn`t take a split but Broadband TV pays them from what they`ve taken!!

PLUS heres something TGN don`t seem to understand it dosn`t matter how big a split they offer because they`re CPMs are Terrible, like litterally some of the worst CPMs on YouTube!
