You're correct. It doesn't matter. Just make sure that the music isn't copyrighted. (I have no idea how people with copyrighted music makes it)
Jup, the copyrighted music was pretty clear to me. But I couldn't really get it in my head how everyone states "IT NEEDS COMMENTARY" where screaming people and music is not really commentary :) Thanks for cleaning that up Pearl!

Okay thanks! So as soon there is something else than just the game sound, it's OK - doesn't matter if it's music or talking? Am I correct?
No. This is completely false. Just because someone has not gotten a strike for their montages with music does not mean it is legal. Think about it logically. Copyright infringement is when you use someone else's copyrighted material without adding substantial value to it pertaining to the copyrighted material. By adding music to your gameplay, you are not doing this. Montages can be argued as fair use, but just having music does not work. Also, your talking needs to be about the game. It should be considered education either by giving some form of help to other players, or it can be a lets play, showing how the game plays out and how to beat it. Technically speaking, uploading a gameplay commentary with a topic not related to the game is illegal (without a network with license agreements). CoD has chosen to ignore this, because it helps to sell their games, but it is illegal. They could give every gameplay commentator (without networks) copyright strikes if they wanted to. If you are uncertain if you can do something, then you probably cannot. :)
 
So what you are saying is: Every Montage either Sniping or Trolling whatever is technically illegal?
No. Most montage makers are partnered. Most networks have agreements with major game companies like Activision giving them the rights. Just because other people do it does not make it legal. Everyone jaywalks, but it is illegal. Tons of people text and drive, but it is illegal (in some states). It is no different. You are using copyrighted material without proper rights to do so. It can sometimes be fair use, but that is very debatable.
