I've Got It
Okay, I'm basically in the process of accepting the RPM Network invitation. However, I want to make sure, I wont get copyright issues. I have an Intro on a lot of videos, however, the music is either free to use or I got the "okay" from the guy who made the music. It's only like 10 seconds anyway (I know that does not really matter, nor makes the music copyright free). I also have two videos, where I used music off of him (e-dubble), I asked him and he told me I'd be allowed.

I'd be obviously able to change the soundtrack via the youtube editor.

And also about the commentary, many people say, the gameplay needs comentary else it is copyright infringement. However, there are so many montages (sniper gameplays whatever) and they don't have any commentary. Also they mostly only have music on it. So how is this not copyright infringement? And what about videos where you don't really talk, but the players in the game do, i.e. they get angry and scream around?

First of all, if they creator said you could use it, then you can use it. Give them credit in the description and note that you have permission. As for montages, it is a very gray area of the law to say the least. In some cases in can fall under fair use, but in others it does not. If what you are doing is adding substantially to the effect of the original piece (i.e. the gameplay), then it can be considered fair use. The music you use in a montage must be creative commons, or you need to get permission from the artist. As a side note, never use YouTube's audio swap. It is a terrible terrible thing for you to say the least.

It is just not properly advertised by YouTube in my opinion. They are not copyright free songs, and you do not have extra rights to use them. Also, you cannot monetize any videos with it on. They will automatically monetize your video, and all profits will go to the artist. Many networks will see it as you using copyrighted music, and they will not accept you. Just stay safe, and use music you have full rights to. Incompetech.com is a good place to go for creative commons music.

That does not answer my question at all.. I am talking about why does it seem montages are NOT copyright infringement or also trolling videos, where YOU don't talk, but other people do rage about something.

Because they talk. That's about it. 100% clean audio from games is considered copyright infringement. As long as some kind of sound (Like talking) is in the video, it "disturbs" the game audio, which makes it difficult to claim.
 
Okay thanks! So as soon there is something else than just the game sound, it's OK - doesn't matter if it's music or talking? Am I correct?
