If account is banned, can you reupload videos

If your youtube channel that had a bunch of your own original content videos is terminated is it against and youtube rules to re upload the videos that were on the banned channel to a new channel?

Bear in mind the ban had nothing to do with the videos but instead was from using a mass messaging system for the account.

Lulz, well thats obvious as of now I got a channel with 140k monthly hits banned. All good though, I'll get my new channels back to that size. Thank you for your answer though
