Machinima won`t release you out of the conract just because you didn`t got over the last couple of Weeks/Months the earning reports if you don`t get in contact with a lawyer to let him deal with it. The Maxium you will get at the current point will be a Sorry and those missing reports but otherwise you won`t get anything else.
Depending on how much you are currently loosing each month compared to last Year I strongly would advise you to get in contact with an lawyer if your earnings drop below 60% - 80% of your last Years earnings and you can proof it that you are really loosing Money each month because your monetizeable Views did increased at least more then 60% for the timeframe.
Don`t even try to be a smart a** and try to believe that your earnings should have increased over the last couple of Months because your unmonetizeable Views did explode over the last couple of Month. Since it seem currently that the longer you wait the worse it will get for you you should get in contact with them right on Monday and make sure to stay calm through the hole phone call and don`t try to be a smart a** or worse.
Explain everything and as long as your old Contract wasn`t renewed in the last couple of Months they will let you leave them in the upcoming Weeks in the longer run if your argumentation sound logic.
I had to deal exactly with the same situation for one of my best friends and after sitting down and talking with the folks over at Machinima they did release him after we talked over a couple of days that it can`t go on as it currently is after they had told him the first time it`s not possible because of the contract he had signed.
Sidenote:
Again if you are really loosing money compared to last Year you will probably get released from the Contract since it will be clear for both sides that things are not as they should be. If you just try to b******t them and tell them that you are currently loosing money because someone else did offer you a better contract don`t even expect an answer to that without having to get in contact with a lawyer to get you out of the contract since those missing reports are only a small part of the contract and it`s more important that you can prove that you are earning less while you should earn more or equal to last Year.
