Game music is a tough one and on a game-by-game basis. For certain games it's obvious that the game published licensed the music instead of producing it in house (the GTA series for instance), but often times it isn't. Equally problematic is that, even if the music is allowed to be used, another video using it could have been entered into Content ID and could could still be flagged and would then have to go through the steps of fighting it.
For the most part, it's far safer to simply turn off any in game music and skip any cut scenes.
