I can't answer that. Suing people is very expensive. But launching a copyright claim and having your video deleted is much easier for them to do. If you're that worried, remove the video.

No you can't. Unless they are distributed under Creative Commons(Commercial) or a Public Domain license. Most promotional pictures are copyrighted.
