I claimed to have license! Since I am part of Machinima Network I had right to monetize the Dead Space 3 video (I confirmed first with Machinima)
In the comment section, I made sure to mention I was part of Machinima.

Although I think you should be fine with Fair Use option as well,

It's worth noting that when it comes to video games, no use is 'fair use'. You need permission for fair use providing you're not making money out of it. So if the person isn't in a network, they cannot claim any ownership :)

Yeah it'd be one thing if he made a vlog with his face and some royalty free stuff for commercial and non-commercial use. Then nobody could say anything. But gaming footage and the visuals/sounds therein are totally copyrighted and unless you own it or have permission/licences, you can't actually use it in any form :)

Fair use is the whole point you don't need permission so long as it falls under the possible criteria

Many Video Game publishers allow you to record your gameplay. Unless it includes commercial licence with it, you just don't monetize it.

Dead Space 3 doesn't fall under fair use though, should've included that. Lots of people are getting claims. I know this particular one is bull puckey (a claim on a green fuzzy screenshot), but many people are getting content matches and claims on bigger games. (non partnered)

That's what I thought, but again I am not expert on the licensing stuff, so did not want to make any statements.
As long as street date is kept and clips are not monetized, I thought it is ok to put it up on youtube, unless the publisher specifically states not to put up their game play footage online.

In Japan, There are several Sound Novel game publisher that comes out and state to not put up their game play footage, I know UBISOFT JPN came out and said not to do Let's Play on Assassin's creed 3, so you just got to confirm with game publisher or your network!
