does this considered as copy right ?

You can probably upload gameplay that you've recorded. Just check around the internet since some companies (like Nintendo) can get funny about it.

no you can't upload real nbahighlights
 
Gameplay should be fine in worst case it can be only claimed by them.The real NBA highlights are big NO NO,even if you put commentery over them,I think they will still not be fine with that cuz why would they let someone else do their job anyway :) So yeah dont risk it with real ones,game should be fine :p
