Video game channels and copyright - developers vs. publishers

I am thinking about setting up a Let's Play channel and I'm wondering about an aspect of copyright law: would you need the permission of the developer, the publisher, or both to avoid copyright claims?

In most of the cases the publisher is who you have to ask permission.

It would also be good to be checking the music of the game because in some cases the music is claimed, not the game.

I run a let's play channel and have covered over 80 games. I have never asked for permission to play a game, your content meets the legal requirements for fair use or fair dealing under applicable copyright laws. Just don't upload games that are unreleased and you should be fine.

You may however have to turn off in-game music as companies love to file content ID matches would would prevent you from monetizing videos (showing ads = making money). Sometimes companies can block your videos aswell for audio and visual matches, there's nothing you can really do about it.

Are you talking about licensed music or original scores?

I speak of licensed music as many games licensed music which is then claimed by copyright.

Similarly the Original scores can be claimed (although this is rare) Some publishers ask that music be administered by third parties (such as Adrev, INgrooves, and others) and these could claim copyright.

We need less of this guessing please. You didn't find out anything about what the person is going to be doing on the channel outside of the "Let's Play", and subsequently quoted a legal opinion that fair use, a defense ONLY available in a court room applies to his content and that this determination somehow has something to do with YouTube. None of those things are true.

Right now, on YouTube the content owners hold all of the cards. We can blather on about fair use all we want, but the fact that Nintendo is basically running their own MCN right now means that fair use isn't enough. Your best bet is always to seek permission where possible. However, some have done the work for you.
