Using things for only a few seconds mean no copyright?

Gods of Odds

Loving YTtalk
Is it true that if I only use something for a few seconds then it isn't copyright at all? Also does that still apply if I use it for say 10 seconds? What is the maximum amount of time I can use it for and it still be ok?
Thanks so much to anyone who helps me in advance, this will really help me if it's true.

what i have found out well with my case that if i use a song for longer then 30 seconds then i get copyrighted but any shorter i dont get a copyright

There is always a copyright. Always... need it be only 1 second or a full song, it's copyrighted.

ContentID may not flag you if it's under 10 seconds, but that doesn't mean that it won't in the future or that you're off the hook - you could still be claimed manually.

Ok thanks for the replies so basically I still have to worry about copyright no matter what. I see loads of big YouTubers use pictures that absolutely must be from Google though and they get away with it over and over again so maybe I shouldn't be too worried.

...and I would ask how you know where the images came from or that they're getting away with anything? They could have been claimed or paid for the rights to use them and you'd never know... nor do you see the countless videos that have been pulled due to claims.

Using still images, especially on a smaller YouTube channel is far safer than using audio or video that you don't have the rights to, but it isn't without worry and can still be claimed by the owner if they find you... something that you may not see any reason to worry about now, but could easily come back to haunt you if you grow.

I have always been worried about it and that is why I have stayed away from it now with this new lore series that I'm starting there is literally no other place to get SOME of the picture that I really need to use and yes I have looked for a very long time. All the pictures I am using have been used by other people/websites but yes I know that doesn't mean I won't get copyright still. In regard to the music I will not use any at all unless it is on a copyright free music sight or if I have complete permission from the owner.

@Shakycow is totally correct, so I just wanted to amplify that first and foremost. There is no "safe harbor" rule or "de minimis" threshold for copyright.

So, really, the question is whether you think that content ID will identify your copyright infringement, and if it does not, will the original copyright owner manually find and claim your video?

Most people aren't looking on youtube 24/7 for videos that happen to use their copyrights. That being said, you're still violating copyright, so someone *could* claim or issue a takedown notice if they did find it.

Ok i do agree with all of what you said but then what do all the other bigger YouTubers do? Where do they get all of their pictures from if not google? I mean YouTubers like ShoddyCast or other people like them.

I'd say the vast majority of YouTubers either unconsciously (most people simply don't understand copyright) or consciously (most people don't care about copyright) just go ahead and break copyright -- because realistically,

1) most copyright owners are not tracked in content ID (so no automatic matches -- my understanding is that youtube does not track ANY photos in content ID...only some music and video clips),
2) most copyright owners aren't searching youtube to see who is using their pictures,
3) most copyright owners do not have the time/money/energy to try to get every video using their copyrights taken down, and/or
4) some copyright owners are "OK" with uses of their intellectual property, because they recognize it as free advertising (many game developers may actually have statements saying they are OK with Let's Plays)

However, I would also say these things:

5) REALLY big youtubers who are part of good networks likely have their networks license whatever needs to be licensed. Since their networks handle the licensing, they are not illegally infringing the copyright. (Most networks don't do this for most of their partners, however.)

but also

6) It's always possible to use creative commons/public domain footage, or even to pay once for royalty-free images/video/songs. I doubt that most youtubers are doing this, but when you use public domain or creative commons footage, then that means the copyright owner's rights are lessened (either by statute or by their choice)

Thanks for your reply, it has helped me out. Some of the picture that i absolutely have to use if i want to do this series i have to get of Google as i have looked loads and the sort of pictures i need are literally nowhere at least not on the free pictures sites.
