Using named brand products in a video.

Sorry if this is in the wrong place, please feel free to move it if it is.

I'm just curious about the use of named brands in videos, for example if I was to make something using a certain chocolate, can I name the chocolate, recommend it, advise against it? etc.

Is it possible to monetize videos with named products? Just crossed my mind and I'm curious but all Google searches are proving to be fruitless.

Cheers,

SimonSez.

The primary issue with products is ensuring that you don't come across as representing the company or owning its' trademarks.

So if, for example I simply said I'm using 'X chocolate' and didn't try to 'sell' it to the viewers that would be ok?

Yup you're fine :) Usually the reason that people don't name a product is because of broadcast rules about giving unequal promotion to one brand over its competitors (for the BBC at least) or because they think that they can get the brand to pay them to have the product "placed" in their media (think any HBO show and Apple computers...) There's certainly nothing to stop you reviewing and naming a specific brand, just as long as you don't claim to be supported by or representing that brand, or use that branding to sell your own product. Eg. You couldn't claim you were creating videos on behalf of Coca Cola, but you can certainly say "I'm drinking coca cola, I like coca cola, I'm using it in this cocktail I'm making because [xyz reasons]" etc.

I'd google the product name your trying to make. Otherwise you can be sued or taken down for it.
I give you this though if someone does steal a trademark you made be readdy to fight for it!
