I did do some searching regarding this question before posting but all replies on Google seemed to just revert back to 'you can use royalty free instrumentals' but they didn't actually answer the question which is:
Can you use instrumentals of 'popular' songs without getting a strike on your video?
I would have assumed not, however, I have seen plenty of people do it, albeit, bigger names but the songs they use are such big songs I wouldn't have thought even someone of their standing within YouTube would have been able to acquire the rights to use the instrumental but there again I'm sure the way it works when you're that popular is a bit different.
The example that initially got my attention was WillNE having used the instrumental to Big Sean's 'Living Single' as his background music throughout the entirety of some videos in the past. I just had another quick look too and he's used bits of Men At Work's 'Down Under' in intros and also Kanye West's 'Black Skinhead' in others, to name a few...
Now obviously I'm talking about a channel which is currently standing at 2.9m subs so, like I said earlier, I'm sure at that point it's a bit different.
But, one main argument I have for the use of some instrumentals is, a lot of the time these instrumentals or beats are sampled from elsewhere or just outright taken from one song and sung or rapped over to make another so surely there's an aspect of if your video has enough other noise going on throughout be it you talking or singing or just other noise then doesn't that make it fair use?
I'm sure the answer is no but there's a small part of me that just isn't convinced but I don't really fancy giving it a chance at the risk of 1 of my 3 strikes!
