Should Claim Fair Use for Copyright Claims?

I've Got It
Hi,

I made a video previewing the men's 100m sprint in the Olympics and it is getting a tonne of views (coming up to 500k). A couple of days ago (after the video had been up for over a month), I got two copyright claims from the International Olympic Committee because I used clips of their videos in my video. They are now getting the ad revenue from my video which is substantial and it will be even more as the event approaches.

I do have the option to claim fair use. My question is: do you think I should? What's the risk in doing that? Will I get a strike if unsuccessful? I'm pretty sure that my video is fair use as I talk over the clips continuously, but I'm no expert.

Cheers.

Have you checked to see what parts of the video they are claiming...but fair use only allows small clips like you would see in a video or game review, if the clips of any of those races lasted for 15 seconds or longer they can claim it....I found that out the hard way

Here's my understanding: Fair Use applies whenever your use of the content "transforms" its original intention. So when someone uses another person's footage and makes fun of it, the footage is now being used for the purpose of humor.

If the purpose of using their footage was the same as its original intention, ie: To entertain people with a sporting event, then you may be on dicey footing.

This isn't the only consideration but this is something that comes to mind.

I think that since it's such a delicate situation, it might be best to just leave it alone. Sure, they might be getting the revenue but at least you're getting the traffic and the views.

The clips they are claiming are 17 and 15 seconds. :(

My use isn't very transformative. :( I basically preview this year's event by first discussing (and showing) the last three Olympic 100m finals.

That's true. I think I won't risk it.

Hi, I've moved this to the forum. :)

Thank you. :)
